Town of Marion, Louisiana SMS Program

These SMS Terms & Conditions (“SMS Terms”) govern text messages sent by or on behalf of the Town of Marion, Louisiana (“Town,” “we,” “us,” or “our”).
By voluntarily opting in to a Town SMS messaging program, you agree to these SMS Terms.
1. Program Description
The Town may use SMS and MMS text messaging to communicate information such as:
- Emergency alerts
- Water outages
- Boil advisories
- Utility notices
- Garbage or sanitation service changes
- Road, weather, or other municipal notices
- Community events
- Town meetings and activities
- Town announcements
- Appointment or request follow-ups
- Reminders
- Community information
- Promotional information relating to Town-sponsored or community activities
- Other Town-related communications for which you have elected to receive messages
The specific messages you receive may depend on the messaging categories or programs for which you have opted in.
2. Consent to Receive Messages
You will receive recurring text messages from the Town only when you have provided the applicable consent or when otherwise permitted by law.
Depending on the program, you may be given the opportunity to opt in through methods such as:
- A website form or checkbox
- A text-message keyword
- A paper form
- A utility or Town application
- An authorized Town signup process
- Another clearly identified method offered by the Town
Where an online checkbox is used, SMS consent should be voluntary and separately selected rather than required as a condition of submitting an unrelated form.
Consent to receive SMS messages is not a condition of receiving municipal services from the Town of Marion.
3. Message Categories and Consent
The Town may operate different types of messaging programs, including informational/service-related communications and community or promotional communications.
Where separate consent is required for different messaging purposes, opting in to one type of Town messaging does not automatically constitute consent to every other messaging program.
For example, consent to receive a service-related notification does not necessarily constitute consent to receive promotional messages unless you have also selected or agreed to receive those communications.
4. Message Frequency
Message frequency varies.
The number and frequency of messages you receive will depend on Town activity, emergencies, service interruptions, announcements, events, and the messaging programs to which you subscribe.
During emergencies or rapidly changing situations, you may receive multiple messages within a short period of time.
5. Message and Data Rates
Message and data rates may apply.
Charges are determined by your wireless carrier and mobile service plan. The Town of Marion does not charge a separate fee to participate in the Town's SMS program unless expressly stated otherwise.
Contact your wireless carrier if you have questions regarding your text or data plan.
6. How to Opt Out
Reply STOP to any Town SMS message to unsubscribe.
You may also use another supported opt-out keyword if identified in a Town message or messaging program.
After an opt-out request is received, you may receive one final confirmation message stating that your request has been processed.
After that confirmation, you will no longer receive messages from the applicable SMS program unless you subsequently choose to opt in again.
Opting out of SMS does not prevent the Town from communicating with you through other lawful methods.

8. Privacy
The Town respects the privacy of individuals participating in its SMS programs.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
The Town may use technology providers, messaging carriers, aggregators, LeadConnector, and other service providers as necessary to transmit, administer, and support the Town's SMS program.
Such processing does not authorize those service providers to use the Town's SMS subscriber information or consent records for their own marketing purposes.

9. Public Records
Communications with a municipal government may constitute public records under the Louisiana Public Records Law, La. R.S. 44:1 et seq.
Text messages or related records sent to, received by, or maintained by the Town in connection with Town business may therefore be retained or disclosed when required by applicable law.
This does not change the Town's commitment not to share mobile information or SMS opt-in consent with third parties or affiliates for marketing or promotional purposes.
10. Supported Carriers and Delivery
SMS and MMS availability may depend on your mobile device, wireless carrier, geographic location, network availability, and service plan.
Wireless carriers do not guarantee message delivery.
Carriers are not liable for delayed or undelivered messages.
The Town does not guarantee that every message will be received, received immediately, or received in the order sent.
Residents should not rely solely on SMS messaging when immediate action is necessary during an emergency.
11. Emergency Communications
The Town may use SMS as one method of distributing emergency or time-sensitive information.
SMS should not be considered the Town's only emergency-communications method, and the Town cannot guarantee delivery of any specific emergency message.
In an immediate emergency, call 911 or the appropriate emergency service.
12. Mobile Number Responsibility
You are responsible for providing an accurate mobile number and for maintaining control of the mobile device or account associated with that number.
If you change or discontinue your mobile number, you should opt out or notify the Town when appropriate so messages intended for you are not delivered to another individual.
13. Changes to the SMS Program
The Town may modify, suspend, or discontinue all or part of an SMS program at any time.
The Town may also update these SMS Terms to reflect changes in messaging practices, technology, carrier requirements, applicable law, or Town services.
The current version of these Terms will be available at marionla.org.
Continued participation in an SMS program after an updated version becomes effective constitutes acceptance of the updated SMS Terms to the extent permitted by law.
14. No Guarantee of Service
The Town makes reasonable efforts to provide accurate and timely SMS communications but does not guarantee the availability, completeness, delivery, or accuracy of every text message.
SMS messages are provided as a convenience and should not replace official Town notices, emergency instructions, or other legally required communications.
